Abstract

Michele Taruffo's undergraduate thesis, written at the age of 22, is a long, critical, intelligent and cultured essay on the judicial use of commonsense knowledge. Any comparison with today's literary genre is impossible. The work starts from a general framework of the problem, tackled not only in legal, rather in semiotic and epistemological terms. It goes on investigating the relationship between commonsense knowledge and, on one side, the taking of evidence and, on the other side, the presumptions. Finally, the discourse intertwines the subject under study with the judicial reasoning and its control by the Supreme Court. In essence, it is a synthesis of the study and research program, to which Michele Taruffo has dedicated his entire life

La tesi de grau de Michele Taruffo, escrita a 22 anys, és un assaig llarg, crític, intel·ligent i culte sobre l'ús judicial de les màximes d'experiència. Qualsevol comparació amb el gènere literari actual és impossible. El treball parteix d'un marc general de la problemàtica, abordat no només en termes jurídics, sinó semiòtics i epistemològics. Continua investigant la relació entre les màximes d'experiència i, d'una banda, la presa de proves i, de l'altra, les presumpcions. Finalment, el discurs entrellaça el tema, objecte d'estudi amb el raonament judicial i el seu control per part del Tribunal Suprem. En essència, és una síntesi del programa d'estudi i recerca, al qual Michele Taruffo ha dedicat tota la seva vida
